507. Combination of Different kinds of leave — Except as provided otherwise under these rules, any kind of leave under these rules may be granted in combination with or in continuation of any other kind of leave. Explanation.— Casual leave which is not recognised as leave under these rules shall not be combined with any other kind of leave admissible under these rules. There is, however, no objection to Casual leave being followed by quarantine leave. |
508. Combination of holidays with leave — (1) When the date immediately preceding the day on which a railway servant’s leave begins or immediately following the day on which his leave expires is a holiday or one of a series of holidays, the railway servant may leave his station at the close of the day before, or return to it on the day following such holidays, provided that— (a) his transfer or assumption of charge does not involve the handing or taking over of securities or moneys other than a permanent advance;
(b) his early departure does not entail a correspondingly early transfer from another station of a railway servant to perform his duties; and
(c ) the delay in his return does not involve a corresponding delay in the transfer to another station of the railway servant who was performing his duties during his absence or in the discharge from railway service of a person temporarily appointed to it.
(2) in the case of leave on medical certificate:--
(a) When a Railway servant is certified medically unwell to attend office, holidays if any immediately preceding the day he is so certified shall be allowed automatically to be prefixed to leave and the holidays if any immediately succeeding the day he is so certified (including that day ) shall be treated as part of the leave; and
(b) When a Railway servant is certified medically fit for joining duty, holidays if any, succeeding the day he is so certified shall be allowed automatically be allowed to be suffixed to the leave and holidays, if any, preceding the day he is so certified (including that day) shall be treated as part of the leave.
(3) On condition that the departing railway servant remains responsible for the moneys in charge, the competent authority may in any particular case waive the application of clause (a) of proviso to the sub-rule (1).
(4) Unless the authority competent to grant leave in any case otherwise directs—
(a) If holidays are prefixed to leave, the leave and any consequent rearrangement of pay and allowances take effect from the day after the hilidays; and
(b) If holidays are suffixed to leave, the leave is treated as having terminated and any consequent rearrangement of pay and allowances takes effect from the day on which the leave would have ended if holidays had not been suffixed.
Railway Ministry’s decision— All holidays notified locally by Railway Administrations may be treated as holidays for the purpose of rules 506 and
508. Since the declaration of holidays as recognized holidays rests with the President the lists of holidays should be approved by that authority. 507. विभिन्न प्रकार के अवकाश का संयोजन - इन नियमों के तहत अन्यथा प्रदान किए गए को छोड़कर, इन नियमों के तहत किसी भी प्रकार की छुट्टी किसी अन्य प्रकार की छुट्टी के साथ या उसके क्रम में दी जा सकती है।
स्पष्टीकरण - आकस्मिक अवकाश जिसे इन नियमों के तहत छुट्टी के रूप में मान्यता नहीं दी गई है, को इन नियमों के तहत स्वीकार्य किसी अन्य प्रकार की छुट्टी के साथ नहीं जोड़ा जाएगा। तथापि, आकस्मिक अवकाश के बाद क्वारंटाइन अवकाश होने पर कोई आपत्ति नहीं है।
508. छुट्टी के साथ छुट्टियों का संयोजन - (1) जब किसी रेल कर्मचारी की छुट्टी शुरू होने के ठीक पहले की तारीख या जिस दिन उसकी छुट्टी समाप्त होती है, उसके ठीक बाद की तारीख छुट्टी या छुट्टियों की एक श्रृंखला में से एक है, तो रेल कर्मचारी एक दिन पहले अपना स्टेशन छोड़ सकता है, या ऐसी छुट्टियों के अगले दिन वापस आ सकता है, बशर्ते कि-
(ए) उसके स्थानांतरण या प्रभार ग्रहण करने में स्थायी अग्रिम के अलावा अन्य प्रतिभूतियों या धन को सौंपना या लेना शामिल नहीं है;
(बी) उसके जल्दी प्रस्थान में रेलवे कर्मचारी के अपने कर्तव्यों का पालन करने के लिए किसी अन्य स्टेशन से एक समान रूप से जल्दी स्थानांतरण शामिल नहीं है; तथा
(सी) उसकी वापसी में देरी में रेलवे कर्मचारी के दूसरे स्टेशन पर स्थानांतरण में देरी शामिल नहीं है जो उसकी अनुपस्थिति के दौरान या अस्थायी रूप से नियुक्त व्यक्ति की रेलवे सेवा से निर्वहन में अपने कर्तव्यों का पालन कर रहा था।
(2) चिकित्सा प्रमाण पत्र पर अवकाश की दशा में :-
(ए) जब एक रेल कर्मचारी को कार्यालय में उपस्थित होने के लिए चिकित्सकीय रूप से अस्वस्थ प्रमाणित किया जाता है, तो जिस दिन वह प्रमाणित होता है, उसके ठीक पहले की छुट्टियों को स्वचालित रूप से छुट्टी के पहले और छुट्टियों को स्वचालित रूप से उस दिन के बाद की छुट्टियों की अनुमति दी जाएगी जिस दिन वह इस प्रकार प्रमाणित होता है (इसमें शामिल हैं) उस दिन) को छुट्टी के हिस्से के रूप में माना जाएगा; तथा
(बी) जब एक रेल कर्मचारी को ड्यूटी में शामिल होने के लिए चिकित्सकीय रूप से फिट होने के लिए प्रमाणित किया जाता है, तो जिस दिन उसे प्रमाणित किया जाता है, उसके बाद की छुट्टियां, यदि कोई हो, को स्वचालित रूप से छुट्टी और छुट्टियों, यदि कोई हो, उस दिन से पहले की अनुमति दी जाएगी, जिस दिन वह ऐसा कर रहा है। प्रमाणित (उस दिन सहित) छुट्टी के हिस्से के रूप में माना जाएगा।
(3) इस शर्त पर कि प्रस्थान करने वाला रेल सेवक प्रभारी धन के लिए जिम्मेदार रहता है, सक्षम प्राधिकारी किसी विशेष मामले में उप-नियम (१) के परंतुक के खंड (ए) के आवेदन को माफ कर सकता है।
(4) जब तक कि किसी भी मामले में छुट्टी देने के लिए सक्षम प्राधिकारी अन्यथा निर्देश न दें-
(ए) यदि छुट्टियों को छुट्टी से पहले रखा जाता है, तो छुट्टी और वेतन और भत्तों की कोई भी परिणामी पुनर्व्यवस्था छुट्टियों के बाद के दिन से प्रभावी होती है; तथा
(बी) यदि छुट्टियों को छुट्टी के साथ जोड़ा जाता है, तो छुट्टी को समाप्त माना जाता है और वेतन और भत्तों की कोई भी परिणामी पुनर्व्यवस्था उस दिन से प्रभावी होती है जिस दिन छुट्टियां समाप्त नहीं हुई होतीं।
रेल मंत्रालय का निर्णय - रेल प्रशासन द्वारा स्थानीय रूप से अधिसूचित सभी छुट्टियों को नियम ५०६ और ५०८ के प्रयोजन के लिए छुट्टियों के रूप में माना जा सकता है। चूंकि छुट्टियों को मान्यता प्राप्त छुट्टियों के रूप में घोषित करना राष्ट्रपति के पास है, इसलिए छुट्टियों की सूची को उस प्राधिकरण द्वारा अनुमोदित किया जाना चाहिए।
उपरोक्त निर्णय उन कार्यालयों पर लागू नहीं होता है जो केंद्र और राज्य सरकार या केंद्र शासित प्रदेशों द्वारा घोषित छुट्टियों का पालन करते हैं
