Leave not due.(IREC - 528)
(1) Leave not due may be granted to a railway servant in permanent employment subject to the following conditions:--

(i) leave not due shall be limited to the leave on half average pay he is likely to earn thereafter;
(ii) leave not due during the entire service shall be limited to a maximum of 360 days, on medical certificate;
(iii) leave not due shall be debited against the half pay leave he is likely to earn subsequently.
(2) (a) Where a railway servant who has been granted leave not due resigns from service or at his request permitted to retire voluntarily without returning to duty the leave not due shall be cancelled, his resignation or retirement taking effect from the date on which such leave had commenced and the leave salary shall be recovered.
(b) where a railway servant who having availed himself of leave not due returns to duty but resigns or retires from service before he has earned such leave he shall be liable to refund the leave salary to the extent the leave has not been earned subsequently.
Provided that no leave salary shall be recovered under clause (a) or clause (b) if the retirement is compulsorily thrust upon him by reason of ill health incapacitating the railway servant for further service or if he is retired compulsorily on disciplinary grounds or due to pre-matured retirement under para 620 of Manual of Pension Rules or the provisions relating to compulsory retirement of non-pensionable Railway servants on rendering 30 years of service or in the even of his death.
छुट्टी के नियम - छुट्टी बकाया नहीं
बकाया छुट्टी नहीं दी जाएगी।(आईआरईसी -528) (1) स्थायी रेलवे कर्मचारी को छुट्टी बकाया न होने के स्थिति में निम्नलिखित शर्तों के अधीन छुट्टी की स्वीकृति कि जा सकती है:-
(i) बकाया छुट्टी, उसके बाद अर्जित होने वाली संभावित आधी औसत वेतन पर छुट्टी तक सीमित होगी;
(ii) सम्पूर्ण सेवाकाल के दौरान देय अवकाश चिकित्सा प्रमाण-पत्र के आधार पर अधिकतम 360 दिन तक सीमित होगा;
(iii) बकाया छुट्टी को उसके द्वारा बाद में अर्जित किये जाने वाले अर्धवेतन अवकाश में से घटा दिया जाएगा।
(2) (क) जहां कोई रेल सेवक, जिसे अदेय अवकाश स्वीकृत किया गया है, सेवा से त्यागपत्र देता है या उसके अनुरोध पर उसे ड्यूटी पर वापस आए बिना स्वेच्छा से सेवानिवृत्त होने की अनुमति दी जाती है, तो अदेय अवकाश रद्द कर दिया जाएगा, उसका त्यागपत्र या सेवानिवृत्ति उस तारीख से प्रभावी होगी, जिस तारीख को ऐसा अवकाश प्रारंभ हुआ था और अवकाश वेतन वसूल किया जाएगा।
(ख) जहां कोई रेल सेवक, जो देय न होने पर छुट्टी ले लेता है, ड्यूटी पर वापस आता है, किन्तु ऐसी छुट्टी अर्जित करने से पहले ही सेवा से त्यागपत्र दे देता है या सेवानिवृत्त हो जाता है, तो वह छुट्टी वेतन उस सीमा तक वापस करने के लिए दायी होगा, जहां तक छुट्टी बाद में अर्जित नहीं की गई है।
बशर्ते कि खंड (क) या खंड (ख) के अंतर्गत कोई अवकाश वेतन वसूल नहीं किया जाएगा, यदि रेल सेवक पर स्वास्थ्य खराब होने के कारण अनिवार्य रूप से सेवानिवृत्ति थोपी गई हो, जिसके कारण वह आगे सेवा के लिए अयोग्य हो या यदि उसे अनुशासनात्मक आधार पर अनिवार्य रूप से सेवानिवृत्त किया गया हो या पेंशन नियमावली के पैरा 620 के अंतर्गत समयपूर्व सेवानिवृत्ति के कारण या गैर-पेंशनभोगी रेल सेवकों की 30 वर्ष की सेवा करने पर या उसकी मृत्यु की स्थिति में अनिवार्य सेवानिवृत्ति से संबंधित प्रावधानों के अंतर्गत अनिवार्य रूप से सेवानिवृत्त किया गया हो।
