Option of date for fixation of pay on promotion to a higher post.
(i) The Govt. servant promoted to a higher post, on regular basis, gets an option to be exercised for fixation of pay in the higher post as under
a. Either his initial pay may be fixed In the higher post on the basis of clause (a) (I) of FR 22 (I) straightaway from the date of promotion without any further review on accrual of increment in the pay scale of the lower post; or
b. his pay on promotion may be fixed at the stage of time scale of the new post above the pay in the lower post from which he is promoted, which may be fixed in accordance with clause (a) (I) of FR 22 (I) on the date of accrual of next increment in the time scale of the pay of the lower post.
(2) The option should be exercised by the Govt. Servant within one month from the date of promotion. This option is not available in the case of appointment on deputation to an ex-cadre post or to a post held on ad-hoc basis, However, In cases where an ad-hoc promotion is followed by regular appointment without break, the option is admissible as from the date of initial promotion, which should be exercised within one month from the date of such regular appointment.
Note 1 : In the order, promoting the Govt. servant it should be mentioned that he has to exercise the option within one month and that the option once exercised is final.
2. Provision of FR 22(I) (a) (I) also apply in respect of appointment to another post carrying higher responsibilities than the post held by the Government servant) outside the ordinary line which is generally termed as ex-cadre appointment provided that in respect of that ex-cadre appointment the Govt. servant is entitled to or elects to draw pay in the time scale of the ex-cadre post.
उच्च पद पर पदोन्नति पर वेतन निर्धारण हेतु तिथि का विकल्प
(1) नियमित आधार पर उच्च पद पर पदोन्नत होने वाले सरकारी कर्मचारी को उच्च पद पर वेतन निर्धारण के लिए निम्नलिखित विकल्प मिलता है:
a. या तो उसका प्रारंभिक वेतन FR 22 (I) के खंड (a)(I) के आधार पर सीधे पदोन्नति की तारीख से निचले पद के वेतन मान में वृद्धि की गणना के बिना किसी और समीक्षा के उच्च पद पर तय किया जा सकता है; या
b. पदोन्नति पर उसका वेतन नए पद के समय मान के स्तर पर उस निचले पद के वेतन से ऊपर तय किया जा सकता है जहां से उसे पदोन्नति किया गया है, जो कि निचले पद के वेतन के समय मान में अगली वेतन वृद्धि की तारीख पर FR 22 (i) के खंड (a) (i) के अनुसार तय किया जा सकता है।
(2) सरकारी कर्मचारी द्वारा विकल्प का प्रयोग पदोन्नति की तिथि से एक माह के भीतर किया जाना चाहिए। यह विकल्प किसी एक्स - कैडर पद पर प्रति नियुक्ति पर या तदर्थ आधार पर रखे गए पद पर नियुक्ति के मामले में उपलब्ध नहीं है, हालांकि, ऐसे मामलों में जहां तदर्थ पदोन्नति के बाद बिना ब्रेक के नियमित नियुक्ति होती है, विकल्प, प्रारंभिक पदोन्नति की तारीख से स्वीकार्य है, विकल्प का उपयोग ऐसी नियमित नियुक्ति की तारीख से एक महीने के भीतर किया जाना चाहिए।
नोट 1: कर्मचारी को पदोन्नति के आदेश में, यह उल्लेख करना चाहिए कि उसे एक महीने के भीतर विकल्प का प्रयोग करना होगा और एक बार प्रयोग किया गया विकल्प अंतिम है।
2. FR 22(I) (a) (I) के प्रावधान के अनुसार सामान्य लाइन के बाहर सरकारी कर्मचारी द्वारा धारित पद से अधिक जिम्मेदारियां वाले किसी अन्य पद पर नियुक्ति के संबंध में भी लागू होता है, जिसे आम तौर पर एक्स - कैडर नियुक्ति कहा जाता है, बशर्ते कि उस एक्स - कैडर नियुक्ति के संबंध में सरकारी कर्मचारी पूर्व - कैडर पद के समय मान में वेतन प्राप्त करने का हकदार है या इसका चयन करता है।
