The Role of Disciplinary Authority

A key role in disciplinary proceedings is played by the Disciplinary Authority and Inquiry Authority. They are functioning as quasi-judicial authorities.

The important Principle of Disciplinary Inquiry

• “No man should be a judge in his own cause” and hear the other side should be kept in mind before any decision is taken under DAR.

• The inquiry authority while conducting the inquiry has to give reasonable opportunities to the delinquent Railway servant.

• The disciplinary authority has to record his reason before arriving at the final decision for awarding any punishment, exonerate the delinquent, etc.

• It is also to be kept in mind by inquiry authorities that their conclusion is not binding on the disciplinary authority. The case can be remitted back, a fresh inquiry can be ordered, and he can even disagree with the findings of the inquiry.

• In the same way, the decision/s of the disciplinary authority is also not final. It can be modified in Appeal, Revision, and even by a court of law.

• All decisions under RS (D&A) rules have to be reasoned and reasonable.


अनुशासनात्मक प्राधिकरण की भूमिका 

अनुशासनात्मक कार्यवाही में एक महत्वपूर्ण भूमिका अनुशासनात्मक प्राधिकारी और जांच प्राधिकारी द्वारा निभाई जाती है। वे अर्ध-न्यायिक अधिकारियों के रूप में कार्य करते  हैं।

अनुशासनात्मक जांच का महत्वपूर्ण सिद्धांत

 • "कोई भी व्यक्ति  को अपने स्वयं के मामले में न्यायाधीश नहीं होना चाहिए" और  डीएआर के तहत कोई भी निर्णय लेने से पहले दूसरे पक्ष कोसुनें और उन तथ्यो  को ध्यान में रखा जाना चाहिए। 

• जाँच करते समय जाँच प्राधिकारी को दोषी रेल सेवक को उचित अवसर देना चाहिए। 

• अनुशासनिक प्राधिकारी को किसी भी दंड को देने, अपराधी को दोषमुक्त करने आदि के लिए अंतिम निर्णय पर पहुंचने से पहले उसका कारण दर्ज करना आवश्यक होगा।

• जांच प्राधिकारियों द्वारा यह भी ध्यान में रखा जाना चाहिए कि उनका निष्कर्ष अनुशासनात्मक प्राधिकारी पर बाध्यकारी नहीं है। मामले को वापस भेजा जा सकता है, एक नई जांच का आदेश दिया जा सकता है, और वह जांच के निष्कर्षों से असहमत भी हो सकता है। 

• इसी प्रकार अनुशासनात्मक प्राधिकारी का निर्णय भी अंतिम नहीं होता है। इसे अपील, संशोधन और यहां तक ​​कि कानून की अदालत द्वारा भी संशोधित किया जा सकता है। 

 • आरएस (डी एंड ए) नियमों के तहत सभी निर्णय तर्कसंगत और उचित होने चाहिए।
