पास नियम के तहत परिवार, आश्रित रिश्तेदार, परिचारक और गोद लिया हुआ बच्चा के अन्तर्गत कौन कौन आता है? (Hindi/English)

A.  'परिवार' के अन्तर्गत शामिल है

1.  रेलवे कर्मचारी का जीवनसाथी चाहे कमाता हो या नहीं;

2.  पुत्र जो 21 वर्ष की आयु प्राप्त नहीं कर चुके हैं और पूरी तरह से रेलवे कर्मचारी पर निर्भर हैं और  21 वर्ष और उससे अधिक आयु के पुत्र या पुत्र जो जो  मान्यता प्राप्त संस्थानों के बोनाफाइड छात्र हैं।

3. किसी भी उम्र की अविवाहित बेटियाँ, चाहे वह कमाती हो या नहीं;

4. विधवा बेटियाँ, बशर्ते वे रेलवे कर्मचारी पर निर्भर हों;

 5.  कानूनी रूप से तलाकशुदा बेटी जो रेलवे कर्मचारी पर निर्भर है;

नोट: अनुसूची-VII के तहत चिकित्सा आधार पर विशेष पास जारी करने के उद्देश्य से, "परिवार" और "आश्रित रिश्तेदार" शब्द क्रमशः आईआरएमएम, 2000 के पैरा 601(5) और 601(6) में परिभाषित होंगे।

B. 'आश्रित रिश्तेदार' के अन्तर्गत शामिल है

1. मां एवं तलाक शुदा मां

2. अविवाहित या विधवा बहन

3.  इक्कीस वर्ष से कम उम्र का भाई / सौतेला भाई

4.  किसी भी उम्र का अशक्त भाई

5. भाई जो इक्कीस वर्ष की आयु प्राप्त कर चुका है और जो  मान्यता प्राप्त संस्थानों के बोनाफाइड छात्र हैं

6. कानूनी तौर पर तलाकशुदा बहन

7. अनुकंपा के आधार पर नियुक्त विधवाओं के मामले में विधवा सास, चाहे उसके पिता जीवित हों या नहीं। 

 नोट -

1.  बशर्ते कि किसी व्यक्ति को आश्रित रिश्तेदार नहीं माना जाएगा यदि पेंशन, महंगाई राहत आदि सहित सभी स्रोतों से उसकी आय रेलवे कर्मचारी के प्रति माह वेतन के 15% से अधिक है या न्यूनतम पेंशन या पारिवारिक पेंशन  जोड़कर प्राप्त राशि रुपये 9000 हजार से अधिक हो (पुराने पेंशनभोगियों को अतिरिक्त पेंशन के तत्व को छोड़कर)

 2. ऐसे मामलों में जहां पिता कम से कम 7 साल की अवधि के लिए लापता हैं, रेल सेवकों को दिए जाने वाले सुविधा पास/ पीटीओ में आश्रित रिश्तेदारों को शामिल किया जा सकता है, इस समान परिस्थितियों में बहनों को भी पास / पीटीओ दिए जा सकते हैं। हालाँकि, व्यक्ति कब से लापता है, इसका मजिस्ट्रेट द्वारा विधिवत सत्यापित एक हलफनामा आवश्यक है।

C. पास नियम के अंतर्गत 'अटेंडेंट' उन्ही को कहा जाएगा, जो रेलवे कर्मचारी द्वारा निजी सेवा में विशेष रूप से वेतन पर नियोजित किया गया हो।

D. 'गोद लिया हुआ बच्चा' का अर्थ वह बच्चा है जिसकागोद लेने का संतोषजनक सबूत है। 

As per Pass Rule 'Family' means

* Spouse of a railway servant whether earning or not;

* Son or sons who have not attained the age of 21 years and are wholly dependent on the railway servant;

* Son or sons of the age of 21 and above who are Bonafide student of recognized institutions

* Unmarried daughters of any age whether earning or not;

* Widowed daughters provided they are dependent on the railway servant;

* Legally divorced daughter who is dependent on the railway servant;

Note: For the purpose of issue of Special Pass on medical grounds under Schedule-VII, the term "family" and "dependant relatives" shall be as defined in Paras 601(5) and 601(6) respectively of IRMM,2000.

As per Pass Rule  'Dependent relative' means

* Mother including a divorced mother

* Unmarried or widowed sister

* Brother/ Step-Brother under twenty-one years of age

* Disabled brother of any age

* Brother who has attained the age of twenty one years and is a Bonafide student of recognized institutions

* Legally divorced sister

* Widow mother-in-law in case of widows appointed on compassionate grounds, whether her father is alive or not.

 

 Provided that a person shall not be considered to be a dependent relative if his / her income from all sources including pension, dearness relief, etc. exceeds 15% of pay per month of the Railway servant or the amount arrived at by adding minimum Pension/Family Pension of Rs 9000/- (excluding the element of additional pension to old pensioners) and the dearness relief admissible to the pensioners/family pensioners on pension rounded off to the nearest ten-rupee figure, whichever is more. Provided further that dependent relatives may be included in the Privilege Passes/PT0s given to the railway servants in cases where father is missing for a period of at least 7 years Passes/PT0s can also be given to the sisters in similar circumstances. However, an affidavit as to the period since when the person is missing, duly attested by a Magistrate is necessary.

As per Pass Rule 'Attendant' means a person exclusively employed on salary in the personal service of a railway servant.

b) 'Adopted Child' means a child for whom there is satisfactory proof of adoption irrespective of the fact whether such adoption is permissible or not under the personal law governing the railway servant concerned.
