General Rules of MACP - In Cases of Refusal of Promotion ( Hindi / English)



MACP in Cases of Refusal of Promotion

As annexure to RBE 101/2009

1. If a regular promotion has been offered but was refused by the employee before becoming entitled to a financial upgradation, no financial upgradation shall be allowed as such an employee has not been stagnated due to lack of opportunities. If, however, financial upgradation has been allowed due to stagnation and the employee subsequently refuse the promotion, it shall not be a ground to withdraw the financial upgradation. He shall, however, not be eligible to be considered for further financial upgradation till he agrees to be considered for promotion again and the second or the next financial upgradation shall also be deferred to the extent of period of debarment due to the refusal.

2. Cases of persons holding higher posts purely on adhoc basis shall also be considered by the Screening Committee along with others. They may be allowed the benefit of financial upgradation on reversion to the lower post or if it is beneficial vis-àvis the pay drawn on adhoc basis.

It is clarified that the instructions under ACP/ MACP Scheme regarding refusal of promotion is applicable in cases of regular promotions only. Therefore, the employees, who have refused adhoc promotions are entitled to grant of financial upgradation under MACPS subject to fulfilment of other terms and conditions as contained in Board’s letter of even No., dt. 10.06.2009


पदोन्नति से इनकार के मामलों में एमएसीपी

आरबीई 101/2009 के अनुलग्नक के रूप में

1. यदि नियमित पदोन्नति की पेशकश की गई है, लेकिन वित्तीय उन्नयन का हकदार बनने से पहले कर्मचारी द्वारा इनकार कर दिया गया था, तो किसी भी वित्तीय उन्नयन की अनुमति नहीं दी जाएगी क्योंकि ऐसे कर्मचारी को अवसरों की कमी के कारण स्थिर नहीं किया गया है। हालाँकि, यदि stagnation के कारण वित्तीय उन्नयन की अनुमति दी गई है और कर्मचारी बाद में पदोन्नति से इनकार कर देता है, तो यह वित्तीय उन्नयन को वापस लेने का आधार नहीं होगा। हालाँकि, वह तब तक आगे के वित्तीय उन्नयन के लिए विचार किए जाने के लिए पात्र नहीं होगा जब तक कि वह फिर से पदोन्नति के लिए विचार करने के लिए सहमत न हो जाए और दूसरे या अगले वित्तीय उन्नयन को भी इनकार के कारण रोक की अवधि की सीमा तक स्थगित कर दिया जाएगा।

2. पूरी तरह से तदर्थ आधार पर उच्च पदों पर आसीन व्यक्तियों के मामलों पर भी अन्य लोगों के साथ स्क्रीनिंग कमेटी द्वारा विचार किया जाएगा। उन्हें निचले पद पर वापसी पर वित्तीय उन्नयन का लाभ दिया जा सकता है या यदि यह तदर्थ आधार पर प्राप्त वेतन के मुकाबले फायदेमंद है।

यह स्पष्ट किया जाता है कि एसीपी/एमएसीपी योजना के तहत पदोन्नति से इनकार के संबंध में निर्देश केवल नियमित पदोन्नति के मामलों में लागू होते हैं। इसलिए, जिन कर्मचारियों ने तदर्थ पदोन्नति से इनकार कर दिया है, वे बोर्ड के समसंख्यक पत्र, दिनांक 10.06.2009 में निहित अन्य नियमों और शर्तों को पूरा करने के अधीन एमएसीपीएस के तहत वित्तीय उन्नयन देने के हकदार हैं।
